The Competition, offered by the East Rand Mall (“ERM”), is subject to these Terms and Conditions (“T’s and C’s”), as may be amended from time to time. Please read the T’s and C’s carefully and pay special attention to all the terms printed in bold.

 

1.      PROMOTER

1.1     The Competition is organised and conducted by Redefine Retail Proprietary Limited (Registration Number: 2012/079189/07) and Vukile Property Fund Limited (Registration Number: 2002/027194/06)

1.2     The Landlord will make final and binding decisions in respect of all matters relating to the results of the Competition, including any disputes relating to the Competition and no correspondence will be entered into.

1.3     The Landlord reserves the right to amend, modify, change the T’s and C’s at any time and will make the amended T’s and C’s available as set out in 5.1 below.

 

2.      COMPETITION RULES

2.1     To enter the Competition a participant (“Participant”) must be in possession of a valid South African identity document. If the Participant is younger than 18 years old, the Participant must be able to show consent by a guardian or parent and be accompanied by such guardian or parent, if the Participant receives a prize.

2.2     The Competition may not be entered into by any director, member, partner, employee, agent, consultant, and tenant of the Landlord at ERM, the marketing service providers and/or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members.

2.3     The Competition runs from 5 May 2018 to 31 August 2018 (“Competition Period”). Any entries received after the Competition Period will not be taken into consideration.

2.4     Any entry by a Participant is subject to these terms and conditions (“Rules“).

2.5     To enter the Competition, a Participant will be required, for the duration of the Competition Period to comply with the following rules–

  1. Make a purchase/s at any store, outlet, restaurant and/or leisure venue at the ERM to the value of at least R150.00 (One Hundred and Fifty Rand)and retain the till slip (“Till slip”); and
  2. Obtain a loyalty card (“Loyalty Card”) from Information between 8 am to 7 pm on week days which is situated at Entrance 3 of ERM (“Information”),
  3. Present the Loyalty Card and till slip to Information;
  4. Request Information to stamp the Loyalty Card:
    I. Each R150 (One hundred and Fifty Rand) spent entitles a Participant to 1 (One) stamp;
    II. Once a Participant has obtained 10 (Ten) stamps in respect of the Loyalty Card, the Loyalty Card must be dropped into the box at Information (“Entry”).
  5. Record his/her correct contact details on the Loyalty Card. Should a Participant win the Competition, but found to have provided incorrect contact details to the Landlord, the Landlord may, in its sole discretion, disqualify such a Participant. Entries that are unclear, illegible or contain errors will be declared invalid. The Landlord may disqualify any entry should fraud be suspected.

2.6     A Participant may enter as many times as he/she wishes during the Competition Period provided that each entry is accompanied by a fully completed Loyalty Card containing 10 (Ten) stamps.

 

3.      PRIZES

3.1     The Landlord will pick one winner (“Winner”) through a random draw on 1 September 2018 which will be overseen by an Independent Auditor.

3.2     The Winner will, at the expiry of the Competition period, win a cash prize to the value of R25, 000.00 (Twenty Five Thousand Rand) (“Prize”).

3.3     The Landlord will use all reasonable efforts during the first week of September, 2018 to contact the Winner during working hours (8:00 – 17:00) either telephonically or via email on the contact number or email address provided in the Loyalty Card by such Winner.

3.4     If the Landlord is unable to contact or reach the Winner, that Entry will be disqualified and a further random drawing will be conducted by the Landlord to determine another Winner. That Winner will also be contacted by the Landlord via email or telephonically as soon as reasonably practicable.

3.5     The Prize is not transferable and the Prize will not be changed or deferred for any reason whatsoever.

 

4.      PUBLICITY AND DATA PRIVACY:

4.1     By entering, a Participant acknowledges and gives express consent on entry that personal information, including without limitation, name, age, address (including postcode), telephone number and/or email address (“Personal Data”) will be used in connection with the Competition and will be shared with the Landlord and their agents to the extent necessary to conduct the Competition.

4.2     All Personal Data relating to the Participants will be used solely in accordance with the Consumer Protection Act 68 of 2008, the data protection legislation, and will not be disclosed to any third party, except for the purpose of the Competition where applicable unless the Participants gave their express consent to this on entry.

 

5.      GENERAL:

5.1     For the duration of the Competition Period, a copy of these T’s and C’s can, at no cost:

  • 5.1.1   be found on the following website (competition page) www.eastrandmall.co.za, or;
  • 5.1.2   be obtained from East Rand Mall management during week day office hours from 8 am to 5 pm, or;
  • 5.1.3   be requested telephonically on telephone number 011 823 1110;
  • 5.1.4   be found on the ERM Facebook page.

5.2     The Winner may be requested to be photographed for promotional purposes. Images may be published on the Facebook page of East Rand Mall and website page as well as community newspapers and shopping centre retail industry publications. No fees will be payable in this regard. The Winner will be given the opportunity to decline the publication of their images.

5.3      The Landlord reserves the right to terminate the Competition with immediate effect before the end of the Competition Period at any time, if deemed necessary in its sole discretion or if circumstances arise outside of its control. No Participant will have any claim against the Landlord for such a termination.

5.4     Participation in the Competition constitutes automatic acceptance of the T’s and C’s contained herein and the Participant agrees to abide by the T’s and C’s.

5.5     The Landlord does not make any representations or give any warranties, whether express or implicit, that the Participant’s participation in this Competition will necessarily result in the Participant winning a Prize.

5.6     To the extent permissible in law, the Landlord is not responsible and cannot be held liable for any accident, injury, harm, death, loss or damages of whatsoever nature, howsoever arising, as a result of the Participant’s participation in the Competition, unless the Landlord acted fraudulently or with gross negligence.

5.7       Participants are obliged to comply with all applicable laws, including those laws protecting the intellectual property rights of other parties.

5.8     These T’s and C’s will be construed, interpreted and enforced in terms of South African law.
